1. Agreement to these Terms
These Terms of Use (“Terms”) form a binding agreement between you and FunBase (“FunBase,” “we,” “us,” or “our”). They apply to this website and to all FunBase mobile applications made available through the Apple App Store, Google Play Store, or other authorized distribution channels (collectively, the “Services”).
By downloading, installing, accessing, or using any FunBase Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
These Terms are written to apply generically to all current and future FunBase applications unless a specific app includes additional in-app terms.
2. Eligibility
You must be legally capable of entering into a binding agreement under the laws of your jurisdiction. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If an app is intended for a general audience, parents or guardians are responsible for supervising use by minors where required by law.
3. License grant
Subject to these Terms, FunBase grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use FunBase apps for personal, lawful, non-commercial use on devices that you own or control, as permitted by the applicable app store rules.
Except as expressly permitted by law or these Terms, you may not:
- Copy, modify, distribute, sell, lease, rent, or sublicense any part of the Services
- Reverse engineer, decompile, or attempt to extract source code, except to the extent such restriction is prohibited by law
- Bypass, disable, or interfere with security, digital rights, or access controls
- Use the Services to develop a competing product through unauthorized scraping, probing, or misuse
- Use the Services for unlawful, harmful, fraudulent, harassing, or abusive purposes
- Interfere with the integrity, performance, or availability of the Services
- Misrepresent your identity or affiliation when contacting FunBase support
4. App store terms
When you download or purchase FunBase apps through Apple, Google, or another platform, that platform’s terms, policies, and billing rules also apply. In case of conflict regarding distribution, payments, refunds, or store account matters, the relevant platform’s terms may control those issues between you and the platform.
FunBase is responsible for the FunBase apps and related support as described in these Terms and on our Support pages. Platform providers are not responsible for providing maintenance or support for FunBase apps unless required by their own policies.
5. Accounts
Some FunBase apps may allow or require an account. You are responsible for providing accurate information, maintaining the confidentiality of your credentials, and all activity under your account. Notify us promptly at support@funbase.pro if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, create risk, or are used in a fraudulent or abusive manner.
6. In-app purchases, subscriptions, and billing
Certain FunBase apps may offer paid features, one-time purchases, subscriptions, or unlockable content. Prices, renewal terms, trial periods, and cancellation instructions are disclosed at the point of purchase and are processed by the applicable app store.
Unless required by law or store policy:
- Purchases are handled by Apple or Google, not directly by FunBase
- Refund requests should generally be submitted through the platform that processed the payment
- Subscriptions may renew automatically until canceled according to store settings
If you need help related to a purchase, contact support@funbase.pro and include your platform, app name, and relevant order details.
7. Advertising
Free or freemium FunBase apps may display advertisements provided by FunBase or third-party networks such as Google AdMob. Ad availability, frequency, and personalization may vary by region, device settings, consent status, and partner configurations.
You agree not to interfere with ad delivery, measurement, or related integrity protections.
8. User content and feedback
If you submit feedback, suggestions, reviews shared directly with us, bug reports, or other content to FunBase, you grant FunBase a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and otherwise exploit that feedback for any lawful purpose without compensation to you.
You represent that any content you submit does not infringe the rights of others and does not contain unlawful or harmful material.
9. Intellectual property
The Services, including software, design, text, graphics, logos, trademarks, icons, audio, video, and other materials, are owned by FunBase or its licensors and are protected by intellectual property laws. These Terms do not transfer ownership of any FunBase intellectual property to you.
“FunBase” and related brand assets may not be used without our prior written permission, except as needed for legitimate referencing of our apps.
10. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect and process information, including through advertising and analytics providers such as AdMob and Firebase Analytics.
11. Acceptable use of utility features
Some FunBase apps provide utility functions (for example, speaker cleaning tones, device helpers, or similar tools). These features are provided for convenience only and do not guarantee specific hardware outcomes. Always follow your device manufacturer’s guidance and use features responsibly. FunBase is not responsible for damage resulting from misuse or from conditions outside our control.
12. Third-party services and links
The Services may integrate or link to third-party services, websites, or content. FunBase does not control and is not responsible for third-party services. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
13. Disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNBASE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that defects will be corrected.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNBASE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNBASE’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO FUNBASE FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM; OR (B) FIFTY U.S. DOLLARS (USD $50) IF YOU HAVE NOT PAID FUNBASE ANY AMOUNT.
Some jurisdictions do not allow certain limitations. In those jurisdictions, our liability is limited to the fullest extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless FunBase and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.
16. Termination
You may stop using the Services at any time. You may also request account deletion by contacting support@funbase.pro or through our Delete Account page.
We may suspend or terminate access to the Services, in whole or in part, if you violate these Terms, if required by law or platform policy, or if we discontinue a product or feature. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.
17. Changes to the Services or Terms
We may update the Services and these Terms from time to time. When we update these Terms, we will revise the “Last updated” date on this page. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires additional consent.
18. Governing law
These Terms are governed by applicable laws of the jurisdiction in which FunBase primarily operates, without regard to conflict-of-law principles. Mandatory consumer protection laws in your country of residence may still apply and remain unaffected where they cannot be waived by contract.
19. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and any app-specific notices, constitute the entire agreement between you and FunBase regarding the Services and supersede prior agreements on the same subject.
